Driving Under Suspension Laws

You must, under Oklahoma law, have a valid license to operate a motor vehicle on any road or public area.  Therefore, if you have a license under suspension and are driving, you are breaking the law.  Suspending a driver’s license is the state’s way of penalizing you for repeated infractions or other crimes involving vehicles.  Title 47 §6-303 lays out the penalties of driving under suspension:

  1. First Offense: misdemeanor charges, fines ranging from $100 to $500, and/or a potential year in jail.
  2. Second Offense: misdemeanor charges, fines ranging from $200 to $750, and/or a potential year in jail.
  3. Third Offense: misdemeanor charges, fines ranging from $300 to $1,000, and/or a potential year in jail.
  4. Any Offense: 3 months will add to the amount of suspension time

Each time you drive using a suspended license, you are committing a new offense.  For instance, if you drive to a friend’s home, then later drive back to your home it is two separate offenses.  This means you could get 6 months of additional suspension time and two counts of driving under suspension.  Further, if you injure or harm another person while driving under suspension, then you will face much harsher penalties.  These could even become felonies.
