Kidnapping Statutes in Oklahoma

- Taking control over another person without having authority or permission to do so;
- Accomplishing the taking by force, imprisonment, flattery, or other means; and
- Holding the victim against their will, sending them over state lines, or forcing them into some type of service or labor against their will.

Penalties for Kidnapping Charges
Kidnapping penalties are strict. As a result, Oklahoma considers the crime to be a felony. Felony crimes can cost you significant time in prison. Kidnapping in particular can send you to jail for up to 20 years per count. You will also face fines and potential restitution to the victim or the victim’s family.
In cases where the victim is a minor, the fact the victim consents to leave with you is not in most cases a defense. Thus, the only way this can potentially be a defense is if the minor victim is over the age of 12 and you can show that you did not use threats or duress to entice the victim to come.
