What Is An Application to Revoke in Tulsa County Criminal Court

Application to Revoke

In many crimes, an offender is eligible for suspended sentences.  However, you must enter a plea of guilty and then complete a set of tasks in order to have the sentence lifted.  If you do not complete these tasks, or check in with the court on time, you face jail time.  While many offenders successfully complete the requirements of a sentence suspension, some do not.  If you fail to complete the terms of your suspension, then you are subject to an Application to Revoke.

Explaining Application to Revoke in Oklahoma

An Application to Revoke is a legal document the District Attorney must file.  It states that the defendant fails to complete the terms of the sentence suspension.  The DA must file this form in the same court you receive your conviction from.  Further, the DA must also provide evidence of your failure to complete the terms of the sentence.  This form must file.  Otherwise, the court’s hands are tied to take any action against you.

So let’s say that a DA files an Application to Revoke or accelerate against you.  What happens next?  Well, at this point a judge will review the application and rule on its validity.  If the judge deems it valid, the judge will issue an order to revoke your suspended sentence and set a hearing.  This will occur within 20 days after the application files.  If the DA provides enough evidence to show you did not meet the terms of your suspension, then your original guilty plea will become valid.  This means you will face the original jail sentence.
